A judge’s family under siege: Bombay Bar Association demands action against violence

The legal fraternity has rallied in support of retired Justice Gautam Patel after his relatives in the UK were targeted in a string of chilling attacks.

It began with a legal verdict delivered in a courtroom in Mumbai and ended with a bloodied face on a London street. The transition from judicial dispute to physical violence is a terrifying reality for the family of retired Bombay High Court Justice Gautam Patel. Following his 2024 judgment on the sensitive succession issue within the Dawoodi Bohra community, the former judge’s family members have been subjected to a series of escalating threats.

The situation turned grim on April 22, when Justice Patel’s 38-year-old daughter, Aditi, was accosted by a masked assailant during a school run in London. The attacker struck from behind, leaving her with a broken nose and significant injuries. This was not an isolated incident; it was the violent crescendo of a campaign that has targeted the family since August 2025, including a threatening letter received by his wife, Malashri, which led to a police complaint in Mumbai.

The legal fraternity speaks out

On Monday, the Bombay Bar Association (BBA) broke its silence, issuing a scathing eight-point resolution to condemn these acts. Signed by BBA President Nitin Thakker, the document marks a significant show of solidarity for Justice Patel, who was a respected member of the association before his elevation to the bench in 2013. The BBA has now formally urged the Ministry of External Affairs (MEA) to intervene and engage with authorities in the United Kingdom to ensure the safety of the judge’s family.

For the legal community, this is about more than just the safety of one individual. The resolution is blunt: violence against judges or their families is a direct assault on the rule of law and the foundational principle that courts must function without fear or favour. The BBA maintains that while judicial decisions are always open to criticism and legal challenge, the line is drawn at physical intimidation.

Why it matters: The bigger picture

The targeting of a judge’s family over a verdict highlights a disturbing trend where the sanctity of the courtroom is increasingly being challenged by external, often borderless, intimidation. When the fallout of a domestic legal battle travels across continents, it suggests that judicial independence is under pressure not just from local influences, but from a globalised, volatile public discourse.

The fact that these attacks occurred on foreign soil adds a complex layer of diplomatic urgency to the situation. It forces a conversation on how the state protects those who have served on the bench, especially when threats transcend jurisdiction. By taking a firm stand, the Bombay Bar Association is signalling that the institutional integrity of the judiciary depends on protecting its members from the aftershocks of their rulings, even long after they have retired. The coming weeks will likely see increased pressure on the MEA to secure a swift response from British authorities.
