Beyond Borders: CJI Surya Kant Urges Global Legal Framework as AI Reshapes Sovereign Powers

As Artificial Intelligence transforms judicial and sovereign powers, the Chief Justice of India calls for international cooperation to bridge an emerging accountability vacuum.

Addressing a public lecture at the University of London, CJI Surya Kant highlighted that Artificial Intelligence (AI) has become an operational reality that is fundamentally reshaping governance, commerce, and the exercise of judicial authority globally. While acknowledging the technological advancements, the CJI warned that the international community must urgently devise a robust legal framework. He stressed that when AI-driven activities are conducted in one nation but produce significant, often harmful, territorial consequences in another, the current lack of a unified regulatory approach poses a threat to the rule of law.

The Accountability Vacuum

CJI Kant noted that traditional legal systems are built on geography and personal agency—concepts that AI actively destabilizes. Because AI systems often rely on distributed chains involving global developers, cloud providers, and private corporations, pinning down liability becomes an exercise in frustration. The CJI questioned who should bear the burden of responsibility when an autonomous system causes harm: the developer, the deployer, the sovereign government that authorized the tool, or the entities that provided the training data?

The issue is particularly acute in the context of military applications and autonomous weapon systems. The CJI observed that the present legal structure is designed to hold specific persons accountable for their decisions, but AI obscures this intent. Since even the architects of these technologies often struggle to explain the "black box" logic behind specific machine actions, establishing a clear path for legal remedy remains one of the most pressing challenges for global policymakers.

Preserving Constitutional Integrity

The lecture was intended to explore the intersection of technology and democracy, but the event in London also saw moments of friction. Reports indicated that a tense exchange occurred during the session, with an attendee raising questions regarding "dissent in India." While the discourse surrounding the legal implications of AI remained the primary focus of his address, these interruptions highlighted the growing scrutiny Indian judicial figures face on international platforms.

By failing to regulate AI, the world risks allowing power to operate in a legal void, where the traditional protections afforded to individuals and societies are effectively eroded by automated, borderless systems.
