Allahabad HC Grants Bail in Rape and Murder Case, Flags "Outdated" Forensic Infrastructure

Justice Arun Kumar Singh Deshwal, presiding over the case of an accused identified as Manoj, issued the order with what he described as a "heavy heart and great pain," citing the prosecution's inability to provide conclusive scientific evidence to link the suspect to the crime.

The Forensic Failure

The decision hinges on a fundamental breakdown in the chain of scientific inquiry. During the investigation, a vaginal swab was collected from the deceased to establish the identity of the perpetrator. However, the Forensic Science Laboratory (FSL) report failed to generate a complete DNA profile, rendering the sample inconclusive. In his May 21 order, Justice Deshwal observed that such technical failures have become a recurring pattern in criminal proceedings, often resulting in the court being unable to determine the source of biological evidence.

A Scathing Critique of State Infrastructure

The court did not mince words when addressing the root cause of these investigative gaps. Attributing the non-generation of DNA profiles directly to the use of obsolete technology, the bench placed the onus squarely on the state government. The order noted that the government has failed to provide basic, modern infrastructure to its forensic facilities, despite the critical role such data plays in securing convictions in heinous crimes.

"No one can be blamed except the State Government who has many other issues to consider apart from the issue of providing basic infrastructure to FSL," the court remarked. The ruling highlights a systemic concern that extends beyond this specific murder case, suggesting that the state's reliance on outdated machines is inadvertently creating a vacuum where scientific accountability should exist.

Directives for Change

Seeking immediate accountability, the Allahabad HC has directed its registrar (compliance) to forward a copy of the bail order to the Uttar Pradesh Chief Secretary for the perusal of Chief Minister Yogi Adityanath. The court explicitly urged the administration to prioritize the installation of high-end machinery and the recruitment of sufficient, skilled personnel in regional forensic labs.

This intervention serves as a reminder that the integrity of the criminal justice system depends as much on the quality of the laboratory as it does on the arguments presented in court. By highlighting the limitations faced by investigators, the judiciary has signaled that the lack of modernization in state facilities is a hurdle that can no longer be ignored if the state intends to ensure justice for victims.
