The Kerala Administrative Tribunal has brought a temporary halt to the government’s move to remove Dr. K.J. Reena from her post as Director of Health Services (DHS), questioning the basis of the department's disciplinary action.

The corridors of the Kerala Health Department were left in a state of flux this week after the Administrative Tribunal stepped into the controversy surrounding Dr. K.J. Reena’s sudden transfer. The government had originally shunted the DHS to the Ernakulam Regional Public Health Laboratory, a move that triggered immediate pushback from the official. The tribunal, upon reviewing her petition, has now stayed the order, marking a significant setback for the department’s administrative maneuvering.

The government’s primary justification for the transfer appeared to hinge on a claim that Dr. Reena had taken 15 days of leave during the high-pressure period of the Nipah virus threat. However, this narrative quickly crumbled under scrutiny. Records revealed that she had, in fact, taken only two-and-a-half days of leave after duly notifying the Additional Chief Secretary of her health concerns. Faced with this factual discrepancy, the government was forced to issue a corrected order, silently scrubbing the 15-day leave allegation from the record.

Dr. Reena has maintained that the entire process was conducted without a shred of consultation. According to her, she was kept in the dark until the transfer order was officially released. Addressing the allegations, she noted that her professional conduct—specifically regarding the deployment of staff for the Sabarimala pilgrimage season—was being misrepresented to justify what appeared to be a punitive measure.

The bigger picture

This incident shines a spotlight on the often-fraught relationship between bureaucratic leadership and political oversight in the state's health sector. Reports have consistently pointed to the dissatisfaction of Health Minister K. Muralidharan as the driving force behind this administrative overhaul, with Additional Director Dr. V. Meenakshi having been tapped to take over the mantle temporarily.

What makes this case significant is the lack of transparency in the disciplinary process. When a government department miscalculates the factual basis for a transfer—such as the erroneous claim regarding leave duration—it erodes the credibility of the administrative apparatus. By forcing the government to pause and reconsider its actions, the tribunal’s intervention highlights the necessity of due process even in high-stakes roles like the DHS. For the health department, this is more than just a legal hurdle; it is a signal that internal grievances and procedural fairness cannot be bypassed by citing emergency circumstances.
